What is the minimum wage requirement in New York City?

As of December 31, 2020, the minimum wage requirement in New York City is $15.00/hour for all employees. However, the minimum wage requirement may be adjusted depending on the employer's size, industry, and location.

For example, employers in the hospitality industry that receive tips may pay a lower minimum wage, as long as the employee's tips plus wages equals at least the full minimum wage rate. The minimum wage may also be lower for certain youth workers or workers in training programs.

Employers are required to post notices informing employees of the minimum wage rates and to keep payroll records for six years.

If an employer fails to adhere to the minimum wage requirements, employees may file a complaint with the New York State Department of Labor, which may result in a hearing or the imposition of penalties against the employer. Additionally, employees may be entitled to back pay and/or damages if they can prove violations of the minimum wage law.

It is important for employers to stay current with changes to minimum wage rates and to ensure that their payroll practices comply with state and federal laws. Employers may want to consult with an employment law attorney or human resources consultant for guidance on compliance with minimum wage and other employment laws.

If an employee suspects that their employer is violating minimum wage requirements, they should contact a licensed attorney or the New York State Department of Labor for further guidance.
