# What is the difference between a lease and a rental agreement?

As a lawyer, I can provide legal advice regarding the difference between a lease and a rental agreement.

A lease is a contract that creates a property interest in real estate for a set period of time. It is a binding agreement between a landlord and tenant that outlines the expectations and responsibilities of both parties during the tenancy. A lease typically lasts for a year and it cannot be terminated early unless both parties agree or a specific provision in the lease allows early termination. During the lease period, the rent amount is usually fixed and cannot be increased unless otherwise specified in the lease agreement.

On the other hand, a rental agreement is a less formal agreement between a landlord and tenant that gives the tenant the right to occupy the property for a limited time period, usually month-to-month or week-to-week. Unlike a lease, a rental agreement can be terminated with a notice period that is agreed upon by both parties or as required by state laws. This means that the landlord or tenant can terminate the rental agreement with a proper notice period, without being in breach of the agreement. Rent amounts in rental agreements may be increased or modified with proper notification to the tenant.

While a lease and a rental agreement have some similarities, the main difference is the duration of the agreement and the ability to terminate the contract. A lease provides greater stability and long-term commitment, while a rental agreement offers flexibility and short-term commitment.

It is important to note that laws vary by state, and there may be different requirements and limitations for leases and rental agreements depending on the jurisdiction. Therefore, it is advisable to consult with a licensed attorney to ensure that you understand your rights and obligations under the applicable laws in your area.

In summary, a lease is a binding agreement that creates a property interest in real estate for a specified period of time, while a rental agreement is a less formal agreement that grants a tenant the right to occupy a property for a limited time period. Understanding the differences between these two agreements can help you make informed decisions when renting a property.
