What are the requirements to apply for an EB-5 investor visa?

As an immigration lawyer, I can provide you the requirements for applying for an EB-5 investor visa.

Requirements for EB-5 Investor Visa

  1. Invest in a new commercial enterprise: The individual must invest a minimum of $1.8 million in a new commercial enterprise or $900,000 if the enterprise is located in a Targeted Employment Area (TEA). A new commercial enterprise can be either a new business, a recently-formed business, or a business that is restructured in such a way that results in a new commercial entity.
  2. Active management or policy-making: The individual must be involved in the management of the enterprise, either through the day-to-day management or through policy-making.
  3. Job creation: The individual must create or preserve at least 10 full-time jobs for U.S. workers within two years of receiving the visa.
  4. Source of funds: The individual must provide evidence that the investment funds were obtained lawfully.
  5. Admissibility: The individual must be admissible to the United States, which means they cannot have committed certain crimes or pose a threat to national security.

It is important to note that there are limitations and exceptions to these requirements, and application processes and requirements may vary depending on the individual's specific circumstances, the country they are coming from, and other factors. It is recommended to seek the advice of a licensed immigration attorney to ensure that all application requirements are met and to maximize the chances of approval.
