# What are the requirements for starting a non-profit organization in Georgia and how do I go about incorporating it?

To start a non-profit organization in Georgia, you must follow certain legal requirements and incorporate it properly. Here are the steps:

1. Choose a Name: Choose a unique and appropriate name for your non-profit that is not already registered in Georgia. You can do a name search on the Georgia Secretary of State website to check name availability.
2. Choose a Board of Directors: Non-profit organizations require a board of directors to conduct the organization's business. The board must consist of at least three members, and they must all have a fiduciary duty to the organization.
3. Prepare and File Articles of Incorporation: The Articles of Incorporation is a legal document that outlines key information about the organization, such as its name, purpose, and registered office. You must file this document with the Georgia Secretary of State and pay the required filing fee.
4. Obtain Necessary Licenses and Permits: Depending on the type of non-profit you are establishing, you may need to obtain additional licenses and permits from state or federal agencies.
5. Apply for Tax-Exempt Status: To receive tax-exempt status from the IRS, you must file Form 1023 or 1024, depending on the type of non-profit you're establishing. This process can take several months to complete.
6. Develop Bylaws: Bylaws govern the day-to-day operations and internal affairs of the organization. You should consult with an attorney to develop bylaws that are appropriate for your non-profit.
7. Obtain an Employer Identification Number (EIN): You must obtain an EIN from the IRS if your non-profit has employees or if it is required to file federal tax returns.
