# What are the eligibility requirements for obtaining an EB-1 visa as an individual with extraordinary ability in sciences, arts, education, business, or athletics?

As an attorney, I can provide you with detailed information regarding the eligibility requirements for obtaining an EB-1 visa as an individual with extraordinary ability in sciences, arts, education, business, or athletics.

To be eligible for an EB-1 visa as an individual with extraordinary ability, you must fulfill three main criteria:

1. Extraordinary ability in your field of endeavor. This means that you must be able to demonstrate sustained national or international acclaim and recognition for your achievements in your field. This can be shown through various types of evidence, such as receiving major awards or prizes, membership in exclusive professional organizations, or recognition from industry experts.
2. Intention to continue working in your field of endeavor. You must show that you intend to continue working in your field of endeavor in the United States.
3. Benefit to the United States. You must demonstrate that your presence in the United States will benefit the country in some way, such as through creating jobs, contributing to economic growth or cultural enrichment, or advancing scientific or technological knowledge.

In addition to these main criteria, there are a few other important details to know about applying for an EB-1 visa based on extraordinary ability:

- You must file a *Form I-140, Petition for Alien Worker*, with U.S. Citizenship and Immigration Services (USCIS) to apply for the visa.
- You do not need to have a job offer or a labor certification to apply. However, an employer in the United States may sponsor you for the visa if they wish.
- There is no annual cap on the number of EB-1 visas that can be granted.
- You may also be eligible for premium processing, which expedites the processing time for your application for an additional fee.

It is important to note that obtaining an EB-1 visa based on extraordinary ability is a complex process, and it is highly recommended that you seek the assistance of an experienced immigration attorney.
